Spousal and Child Sponsorship To Canada
Of all of the family immigration cases we handle, sponsoring a spouse or child to Canada are by far the most common. The regulations and amount of paperwork may seem daunting, but the process typically takes between 6 - 12 months. Certain conditions apply, such as:

You must be at least 18 years old

You are a Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act

If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.

You can’t sponsor someone if you’re a permanent resident living outside Canada.

Do I have to be married to my partner to sponsor a partner to Canada?
No. Canada recognizes conjugal and common law relationships. However, you will have to prove that the relationship is real.

How much paperwork is involved in proving a spousal relationship is real?
It depends on the relationship. A valid marriage certificate is an essential document, but not enough. You must also include with your application other evidence of your relationship. If you are not married, or if there is some question about the validity of your relationship, then immigration officials will want to see correspondence, photos, and other materials to make sure you are being honest. We will collect those and submit them for you.

Can't I just do the spousal sponsorship application myself?
Yes. Like most things in life, you can do them yourself. Fixing your car, building your house, representing yourself in court. However, you hire a professional to get these things done right. Immigration law is no different. Spousal sponsorship must be done right to avoid delays in the process. Errors can cost you months or years.

I'm not married to my partner yet. Can I bring them to Canada first and get married here?
You must be legally married before you can submit a sponsorship application. If your partner is already in Canada, you may file an Inland Spousal Sponsorship application.

Can I sponsor my spouse's children from a previous marriage?
Yes. You may include your or your spouse's children on the same application.

If I am in a same-sex relationship, can I sponsor my partner to Canada?
Yes. Canada recognizes same-sex relationships and the same rules apply.

Can my spouse work right away when we file a spousal sponsorship application?
No. They will have to apply for a work permit.
